Bombay HC Orders Woman To Pay Alimony To Her”indigent” former husband

Mumbai: The Bombay High Court upheld orders from a district court in Nanded, Maharashtra ordering a women teacher to pay child support to her “impoverished” ex-husband.

In an order given on 26 February this year, High Court Aurangabad Court Judge Bharati Dangre upheld orders of the District Court from 2017 and 2019.

The Civil Court ordered the woman to pay provisional alimony of £3,000 a month to her ex-husband and ordered her principal to deduct ₹5,000 from her salary every month since August 2017 and deposit the same amount with the Unpaid Child Support Court in 2015.

The man had appealed to the district court two years later to claim permanent alimony.

The woman’s attorney argued that after the marriage ended, neither party was entitled to child support or alimony.

However, the man’s attorney argued that Section 25 of the Hindu Marriage Law provided no restriction on claiming alimony or alimony in this manner.

The man stated that he had no source of income and suffered from health problems that made him unable to work.

The woman finished her education and became a teacher after her marriage, she said.

“In order to encourage the wife (applicant) to obtain the title, he settled the domestic affairs and put aside his own ambition,” reads his plea.

Judge Dangre said that sections 24 and 25 of the Hindu Marriage Law give the needy spouse the right to claim alimony and upheld the lower court’s order.
