The EU’s highest court ruled on Tuesday that a Czech porn company can claim financial compensation for online abuse it could have suffered in any EU country where the abusive content can be accessed.
Gtflix Tv, a Czech producer and distributor of adult content, brought proceedings before a French court against a Hungarian individual who had made disparaging comments about its business on the internet. Gtflix wanted the comments to be removed and to be compensated for the harm.
The EU’s Court of Justice found that European national courts can decide to award financial compensation to victims of online harassment if the harmful content was accessible in their own territories.
The CJEU also said that getting online content removed or rectified can only be ordered by courts in countries where the person publishing abusive comments is based and where the victim lives.
